THIS BABY CARRIER RENTAL AGREEMENT AGREEMENT (The “Agreement”) will commence on the purchase date as recorded by Shopify Payments.

(the Renter)

(the Company and the Renter are collectively the “Parties”)

EQUIPMENT INFORMATION

The item purchased through www.heritagebaby.ca named "rental baby carrier" shall be known as the Equipment.

RENTAL INFORMATION

TERMS & CONDITIONS

Term of Agreement

This Agreement enters into force on the above listed “ start date” and will remain in effect until the above listed “end date”. At the end of the rental period, the Agreement will automatically terminate without any warning or notice, but the parties may decide to extend the period in writing, or they may sign a new contract with new terms and conditions.

Rent and Deposit
1. The total price of this Agreement is Shipping Fee. Rent will be paid prior to the Renter taking possession of the Equipment. All payments shall be made via Shopify Payments.
2. The Render will pay a deposit of $100 CAD before taking possession of the Equipment. The Company will refund the Deposit to the Renter at the end of the term provided.
3. The security deposit will be returned to the Renter within 5 business days of the Equipment being returned.
4. The security deposit will be returned once a full inspection of the Equipment is completed and it is returned in the same condition as received by the Renter.

Use of Equipment
1. Leased equipment can only be used by the users or operators assigned by the Company. Except for the use/operator of the leased equipment, all damages (regardless of defect rate) that may occur due to the use of third parties shall be covered by the Renter.
2. The Renter accepts that they have received the product undamaged and is responsible for any damages and loss that may occur to the product. The Renter cannot return a product different from the product delivered by the Company.
3. In case of loss of rented equipment, the Renter immediately notifies the Company and forfeits their security deposit.
4. The Renter will use the Equipment in a good and careful manner and will comply with all of the manufacturer’s requirements and recommendations respecting the Equipment and any applicable law, whether local, state or federal. The Renter will respect the use of the Equipment, including, but not limited to, environmental and copyright law.
5. Unless the Renter obtains the prior written consent of the Company, the Renter will not alter, modify or attach anything to the Equipment.
Warranties
1. The Equipment will be used for personal use only.
2. The Equipment will be in good working order and good condition upon delivery.
3. The Equipment is of merchantable quality and is fit for purposes it is ordinarily used.
Loss and Damage
1. To Renter will be responsible for risk of loss, theft, damage or destruction to the Equipment from any and every cause.
2. If the Equipment is lost or damaged, the Company will provide the Renter with prompt written notice of such loss or damage.
3. The Equipment will be deemed lost once an inspection has been opened with the courier service.
Ownership, Right to Lease
1. The Equipment is the property of the Company and will remain the property of the Company.
Insurance
1. No insurance coverage for the Equipment is required under this Agreeement.
Indemnity
1. The Renter will indemnify and hold harmless the Company against any and all claims, actions, suits, proceedings, costs, expenses, damages and liabilities, including attorney’s fees and costs, arising out of or related to the Renter’s use of the Equipment.

NOTICE TO RENTER

This is a lease. You are not buying the Equipment. Do not sign this Agreement before you read it. You are entitled to a completed copy of this Agreement when you sign it.
